freelance photographers: new rules for sick leave and maternity/paternity leave

Since January 1, 2022, it has been possible for recently self-employed workers (craftsmen, self-employed entrepreneurs) with low incomes to receive daily sickness and/or maternity benefits for their former activity. Regardless of the scheme you were affiliated to.

The usual rule is that in the event of low self-employed income, the amount of the daily allowance received by the self-employed worker may be low or even zero. Since January 1, 2022, health insurance funds have been able to pay a daily allowance calculated on the basis of activity prior to self-employment, if this is more favorable.

1. Who can benefit?

This measure concerns

  • Insureds under the self-employed workers' scheme who have been prescribed sick leaveas from January 1, 2020, for entitlement to sickness insurance daily benefits;
  • self-employed workers who started work on or after January 1, 2019 and whose maternityleave began aftercommenced after November 1, 2019, for maternity insurance daily benefits.

To qualify, self-employed workers must also meet one of the following 2 conditions :

  • have been off work within 12 months of ceasing salaried employment or unemployment benefit from Pôle emploi;
  • currently receive compensation from Pôle emploi for previous salaried employment.

2. How to apply

The request must be made via the "Demande de réétude de dossier indemnités journalières " service available onthe demarches-simplifiees.fr website. Supporting documents must be attached (proof of Pôle emploi registration, pay slips, etc.).

The health insurance fund will receive the file directly via this teleservice, and will then contact the self-employed worker to inform him or her that the application has been processed.
